Former National Security Adviser John Bolton Expected to Plead Guilty to Retaining Classified Information
Former White House National Security Adviser John Bolton is expected to accept a plea agreement with federal authorities on a single count of unlawful retention of classified information, according to sources familiar with the matter. Details of the Indictment
The indictment alleges that from April 2018 through at least August 2025, Bolton transmitted more than one thousand pages of information about his daily activities as national security adviser to two unauthorized individuals. Much of the material was classified at the TOP SECRET/SCI level and concerned matters of national defense.
The documents reportedly included intelligence regarding planned attacks by an adversarial group in another country, information shared by a liaison partner with the U.S. intelligence community, and details of a foreign adversary’s planned missile launch. The indictment further states that Bolton unlawfully retained documents, writings, and notes relating to national defense, including TOP SECRET information, at his residence in Montgomery County, Maryland.
FBI Director Kash Patel stated in October that the investigation found Bolton transmitted top secret information using personal online accounts and retained the documents at his home in violation of federal law. Patel emphasized that the case was built on work by career FBI professionals who followed the facts without fear or favor.
Plea Agreement Terms
Under the anticipated plea deal, Bolton would plead guilty to one count of retention of classified information. The agreement includes the $2.25 million fine. Prosecutors and defense counsel have not publicly detailed any recommended sentence beyond the fine, and the final penalty will be set by the court.
Bolton is 77 years old. A felony conviction would remain on his record regardless of whether prison time is imposed.
